1. Acceptance of Terms

These Terms & Conditions ("Terms") are a binding agreement between you and OwlScan ("OwlScan," "we," "us," or "our") governing your download, access, and use of the OwlScan application and any related services (the "App"). By downloading, accessing, or using the App, you agree to these Terms in full. If you do not agree, do not download, access, or use the App.

2. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country, to use the App. If you are under the age of majority where you live, you may only use the App with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and takes responsibility for your use of the App.

3. License Grant

Subject to these Terms and Apple's Licensed Application End User License Agreement, OwlScan grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for your personal or internal business use. All rights not expressly granted to you are reserved by OwlScan.

4. Use of the App

OwlScan is a document scanner for iPhone, iPad, and Mac. It helps you scan, organize, search, tag, edit, and export documents, track warranties, and build expense reports. You are solely responsible for the documents, images, and other content you scan, store, share, export, print, import, or sync using the App, and for making your own backups; OwlScan is not a substitute for maintaining your own copies of important documents.

5. Free and Pro

OwlScan Free includes on-device scanning, OCR search, tags, receipt CSV and watermarked expense report exports, warranty tracking, and Apple Wallet passes. OwlScan Pro is an optional subscription that unlocks full OCR text access and copying, on-device AI summaries (on supported devices with Apple Intelligence, iOS 26 or later), annotation and page editing, folders and Smart Collections, bulk actions, automatic photo import, optional iCloud document sync across iPhone, iPad, and Mac signed in to the same Apple Account, App Lock, warranty expiry reminders, the rainbow theme, and watermark-free expense reports. Feature availability may change and may depend on your device, OS version, and region.

6. Subscriptions and Purchases

OwlScan Pro subscriptions are billed monthly or annually through Apple's StoreKit and auto-renew unless canceled at least 24 hours before the end of the current period. Purchases, renewals, cancellations, refunds, and restoration are managed entirely by Apple through the App Store and your Apple Account settings; OwlScan does not process payments directly, does not control Apple's billing or refund decisions, and cannot itself issue refunds.

7. Your Content

You retain all ownership rights in your documents and content. You grant OwlScan only the limited permission needed to process that content on your device, and, where you choose to use a feature that requires it, to transmit content to Apple's iCloud (sync) or to OwlScan's pass-signing service (Apple Wallet passes), solely to provide that feature. OwlScan claims no ownership over your content.

8. Apple Wallet Passes

Creating an Apple Wallet pass from a warranty or a scanned barcode requires an internet connection. Doing so sends the barcode and pass details you select to OwlScan's pass-signing service so it can return a signed pass. This feature is unavailable offline or if that service is unreachable, and OwlScan is not liable for any pass that cannot be created or delivered as a result.

9. Prohibited and Unlawful Use

You agree that you will not, and will not attempt to:

• use the App for any unlawful purpose, or to violate any local, state, national, or international law or regulation;
• scan, store, export, share, or otherwise process any document, image, or data that you do not have the legal right to possess or use, including another person's identity documents, private records, or copyrighted material;
• use the App to harass, defame, impersonate, stalk, or invade the privacy of any person, including using the Contacts export feature to collect or distribute someone else's personal information without a lawful basis;
• use the App to create, store, or distribute fraudulent documents, counterfeit passes, tickets, or credentials, or any content intended to deceive or defraud another person, business, or government body;
• reverse engineer, decompile, disassemble, modify, or create derivative works of the App, except to the extent such restriction is prohibited by applicable law;
• circumvent, disable, probe, or interfere with security features of the App or of OwlScan's pass-signing service, or attempt to gain unauthorized access to it, including by sending malformed, excessive, or automated requests;
• rent, lease, sell, sublicense, resell, or otherwise commercially exploit the App itself, or use it to build a competing product or service;
• introduce viruses, malware, or other harmful code through the App, or use the App in any manner that could disable, overburden, or impair it or Apple's or OwlScan's supporting services; or
• use the App in violation of applicable export control or economic sanctions laws.

OwlScan may suspend or terminate your access to the App, without notice, if we reasonably believe you have violated this section.

10. Intellectual Property

The App, including its design, features, source code, trademarks, the OwlScan name and logo, and all related intellectual property, is owned by OwlScan and is protected by applicable intellectual property laws. Nothing in these Terms transfers any such rights to you beyond the limited license in Section 3.

11. Third-Party Services

The App relies on services operated by Apple (including StoreKit, iCloud/CloudKit, Vision, Apple Intelligence, and Contacts) and by Google Firebase (Crashlytics crash reporting). Your use of these integrated services is also subject to their respective terms and privacy policies. OwlScan does not control these third parties and is not responsible for their availability, accuracy, or any loss arising from their outage, change, or discontinuation.

12. No Professional Advice

OwlScan may help organize or summarize documents, but it does not provide legal, tax, medical, financial, or other professional advice. On-device AI summaries may be incomplete or inaccurate. Review important documents yourself and consult a qualified professional when needed.

13. Availability and Changes

Features may change, be limited, or be discontinued over time, and may depend on device capabilities, iOS, iPadOS, or macOS version, Apple Intelligence availability, Apple services, iCloud availability, and App Store subscription status. OwlScan is not liable for any unavailability of a feature caused by factors outside its reasonable control.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. OwlScan does not warrant that OCR, AI summaries, exports, Apple Wallet pass creation, iCloud sync, or any other document processing will be accurate, complete, uninterrupted, timely, secure, or error-free, or that any data loss will not occur.

15. Indemnification

You agree to indemnify, defend, and hold harmless OwlScan and its developer from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the App; (b) any content you scan, store, export, share, or transmit through the App; (c) your violation of these Terms or of any law or regulation; (d) your violation of any right of a third party, including privacy, publicity, or intellectual property rights; or (e) any fraudulent, unlawful, or unauthorized use conducted through your device or account.

16. Limitation of Liability

To the fullest extent permitted by law, OwlScan will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of documents, data, profits, revenue, or business opportunities, arising out of or related to your use of, or inability to use, the App, even if OwlScan has been advised of the possibility of such damages. To the fullest extent permitted by law, OwlScan's total aggregate liability arising out of or related to these Terms or the App will not exceed the greater of (i) the amount you paid OwlScan for OwlScan Pro in the twelve (12) months before the claim arose, or (ii) twenty US dollars (US$20). Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties, so some of the above limitations may not apply to you.

17. Termination

You may stop using the App at any time by deleting it from your device and, if applicable, canceling your subscription through your Apple Account settings. OwlScan may suspend or terminate your access to any online feature of the App (such as Apple Wallet pass creation) at any time, with or without notice, for any violation of these Terms or for any other reason. Sections of these Terms that by their nature should survive termination will survive, including Sections 7, 9, 10, 11, 14, 15, 16, 18, and 19.

18. Governing Law and Dispute Resolution

These Terms are governed by the mandatory consumer protection laws of your country or state of residence, to the extent such laws apply, and otherwise by generally applicable principles of contract law without regard to conflict-of-law rules. Before starting a formal proceeding, you agree to first contact us at the email below so we can attempt to resolve the dispute informally. To the fullest extent permitted by the law of your place of residence, any dispute arising out of or relating to these Terms or the App will be resolved by binding, individual arbitration rather than in court, and you and OwlScan each waive any right to a jury trial or to participate in a class, consolidated, or representative action. Where binding arbitration or a class-action waiver is not enforceable under the mandatory law of your jurisdiction, that provision will not apply to you, and disputes will instead be brought in the competent courts of your place of residence.

19. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and OwlScan regarding the App and supersede any prior agreements on this subject.

20. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after an update constitutes acceptance of the revised Terms. The effective date above reflects the last update.
